Da'Niyah Marie Jackson

Find A Grave Memorial

On a Thursday evening in November of 2007, a helpless Angel was raped and beaten and even bitten by a man her mother had trusted to take care of her and her two year old brother. Da'Niyah Jackson was only ten months old when Clinton Smith, a 30 year old man, took it upon himself to assault her and that assault would leave her on life support for two days before she died.

Though Da'Niyah had bruises on her face, arms and legs as well as bite marks on her chest, Clinton claimed that she was laying down and he was getting ready to change her diaper when he put her on her stomach and pushed hard which caused her to vomit, claiming he was playing with her. Clinton claims he put the baby into her playpen where she stayed until her mother, Latoya Jackson, came home about 9:30 p.m. and saw her child was bruised and would not respond to her.

Da'Niyah's injuries lead police to believe that her injuries were more than just from being pushed in her stomach:

"I find it hard to believe the statement he gave us is the complete truth. What he told us is a partial
truth. It was a self serving statement"
Police Lt. Daniel Hermann

Clinton told police that any other injuries the baby had were given to her by her brother and said she had also fallen. Neighbors were in shock by what had happened to this beautiful baby girl:

"It's just so horrible. When I heard it happened right here, you just think is there something I could have done" Mary D. "It's something I still haven't gotten over that it could happen. I can't imagine anything like this ever happening again" John T.

John said that the death of Da'Niyah was the most shocking thing that had taken place in the neighborhood he has lived in for 45 years.

Information that I have read said that Clinton Smith was being held on homicide charges which were added to the charges of aggravated assault, reckless endangerment, rape and endangering a child he faced before this precious baby died and was due for a non jury trial on April 13, 2009. In June of 2009, Mike Manko a Spokesperson for the Allegheny County DA's Office said that Clinton was still behind bars waiting for his trial which had been rescheduled for September. At that time it was also reported that Clinton was going to have a jury trial.

In 2009, Latoya was in court, reading a statement that told how the death of her daughter was affecting her:

"Who would have ever thought that I would give birth and bury a child all in the same year?"
He has not only robbed me of my daughter but he has taken away my trust. I'll never know
what it's like to spend any holidays with her. I've missed out on her first steps, her first birthday,
her first Christmas. I didn't even get to experience her first tooth. Her life was taken so abruptly,
and I struggle every day because I don't know why. All I'm left with is pictures and memories.
I know that today justice will prevail for my precious baby, and that her offender will receive a
punishment suitable for the crimes that were committed, but that still doesn't ease my pain.

There is nothing anyone can do to bring my daughter back, and for that reason, alone, I will
suffer for the rest of my life, and I hope that her offender does, too"

Latoya was in court as Clinton D. Smith, who was then 32 years old, was sentenced by Judge Edward J. Borkowski, to life in prison without the possibility of parole. Clinton had plead guilty to first degree murder and endangering the welfare of a child and was given a plea deal in which two counts of deviate sexual intercourse were taken off of the table as was the death penalty.
