How is it that when a child dies after being put through hell, the people responsible for her DEATH, are charged with injury to a child? Breonna Loftin's mother, Amanda Nichole Guidry, who was 30 years old at the time and Jason Wade Delacerda, who was 34 at time, were being held on 1.5 and 2 million dollar bails due to the fact that they had killed Breanna.
 


How can the death of a child be called injury to a child? Breonna's body was so badly bruised and beaten that it was obvious she had been suffering for months. Shari Pullium, who was a spokeswoman for the Texas Department Of
Family And Protective Services said:

"The community is really struggling with this because we all feel a sense of responsibility.
The message to the community is, it is your responsibility and it is your business"

Shari wanted to urge people to report any suspicions they have of child abuse to the Family and Protective Services, so that investigations could be done. Agreeing with her was Marion Tanner who was the director of Garth House, advocates for children, though she was sure to say she wasn't pointing fingers at anyone and she stated:

"I know the neighbors are shaken that it happened"

Breonna died at the Beaumont Hospital on August 17, 2011 after an examination showed burn marks, bruises and signs of sexual abuse to her four year old body. The cause of Breonna's death was listed as blunt force trauma. It would later come out that Jason could basically do anything he wanted to Breonna and her mother wouldn't protect her, choosing instead, like so many other IDIOTS, to keep the man she so badly wanted in her life. Witnesses came forward to state that they has seen Jason abuse Breonna by making her stand on water bottle caps while he he hit her on her head. Jason was also allowed to spanker her and at one point threw her across the room and her mother did nothing. Why didn't the witnesses call police or help this little Angel? I hope they are also being prosecuted for the torture this child went through and for doing nothing to help her.


In August of 2011, the court appointed C. Haden Cribbs as Jason's lawyer and Jimmy Hamm as Amanda's lawyer. Each of these lawyers were qualified as capital murder case lawyers and David Sheffield, the District Attorney said that a grand jury could upgrade the charges the couple faced. A funeral was held for Breonna and the Sheriff's office made it known that Amanda would not be allowed to go. I have to wonder why a woman who abuses her daughter for months until the child finally gives up and dies, would even ASK to go to her funeral.

On August 29, 2011, the District Attorney's office was ready to ask the Grand Jury to indict Amanda and Jason on capital murder charges, which David Sheffield said would be an upgrade from the injury to a child charges they faced at the time. In Texas, the Penal Code states that killing a child under the age of six is a capital murder offense. David said that they would seek the death penalty because he felt that what Breonna went through was worth the death penalty:

"We're going to seek the death penalty in this case because justice for the sadistic torture and
death of this child demands it. When you see what was done to an innocent child, who does not
deserve any maltreatment, to see the nature of the torture and injuries and stuff, it does strike you
down to your core"

I read online today, July 19, 2013, that the trial for Jason has been postponed and that there has not been a new date set at this time. The same article said that Amanda would go to trial later in the Spring. Since it is Summer now, I assume they mean the Spring of 2014.

Breonna Nichole Loftin

Breonna Nichole Loftin, 4, of Vidor, died Wednesday, August 17, 2011, at Christus Hospital St. Elizabeth in Beaumont.
She was born on December 29, 2006, in Beaumont, to Amanda Nichole (Guidry) and John Edward Loftin, Jr. and lived in Vidor most of her life.

Survivors include her father, John Edward Loftin, Jr. of Vidor; mother, Amanda Guidry of Beaumont; grandparents, John Edward Loftin, Sr. of Vidor, Thelma Wilson of Newton, Ronald and Sandy Guidry of Vidor, and Wanda and Brian Bailey of Beaumont; and numerous aunts, uncles cousins and friends.

Her funeral service will be 10:00am Tuesday, August 23, 2011, at Eastgate United Pentecostal Church, 290 South Street, Vidor with burial to follow at Restlawn Memorial Park in Vidor under the direction of Broussard's, 530 W. Monroe, Kountze. A gathering of her family and friends will be Monday evening, August 22, 2011, from 5:00 p.m. until 8:00 p.m. at Broussard's.

UPDATE:

Today is June 12, 2014 and I am searching for updates and am only able to find out that the trials have been delayed several times due to evidence needing to be tested for DNA. I was also able to find out that prosecutors will ask for the death penalty in this case.

UPDATE: June 17, 2016 -

Reports came out saying that Jason Wade Delacerda would be going to trial in the year 2016, though no specific month or day was given. It was also reported that the state would be seeking the death penalty against Jason.

Amanda Nichole Guidry is set to go to trial some time later in the Spring of 2016 on a capital murder charge.
