The body of a beautiful, little Angel was found in the bathtub on July 29, 2016 after Britney Roll Mayes, her mother, called 911 to report that her daughter had been complaining about being hot:

"She was complaining she was hot, so I went to put her in the bathtub
to cool her down and she stopped breathing and she had no heartbeat"

During the six minute phone call, the 911 dispatcher had given Britney instructions on how to give Avery CPR. The Dispatcher asked Britney question such as: Does she have any injuries to which Britney responded:

"Nothing she didn't go to bed with, just a couple bruises"

First responders removed Avery from the tub and found her to be unresponsive, she was taken to Children Hospital where she died. An autopsy would later show that Avery had died of blunt force trauma

Information would come to light about an incident when Avery was only four weeks old in 2011 and had sustained a fractured skull and Britney admitted that she had caused that injury to her daughter. Britney was given a six month jail sentence at that time for endangering a child.

During Britney's incarceration, her paternal grandparents were given custody of her. Reports show that both sets of grandparents as well as Britney were fighting for custody of Avery at one point. When Britney was released from jail, she was granted custody of Avery though there were many questions in the minds of those around her of how a mother who caused such a serious injury to her child, could be granted custody of that child once again.

As it turns out, a child advocate by the name of Julie Pederson suggested to Judge DeMott that Avery be returned to her mother. Julie Pederson insisted that once a parent completes all the classes required and takes the necessary steps to gain custody back:

"It is generally best for a child to be raised by a parent"

I guess Julie Pederson and Judge DeMott are the kind of people who makes mistakes that cost innocent children their lives. Sending a child back into the home right away is ALWAYS a mistake. Parents can fake it through the classes and often do. I hope in the future that Julie Pederson will start with supervised visitation and stretch that out for a long time before allowing short visits at home alone for a few hours and then over a period of time, one overnight visit a week and work her way up to just assuming that just because someone is a parent who took a few classes, that makes them a good parent. I hope if she is not capable of protecting children, that at least the Judges in her cases will help the children.

Later it would be said that not enough was done to keep Avery safe:

"We fought as hard as we could to keep her safe. I don't understand
our laws, I don't understand our system"

Jonathan and Tammy said that she was a little jokester who would laugh all the time. Her favorite movie was "Frozen".

Britney asked the courts to give her custody of her daughter and in court said that her father, Jamie Hobbs did not have a job and had basically abandoned his daughter who he had not contacted in over a month, she added that he has no high school education and is a convicted felon. Just one month later, Tammy Risen said of Britney:

"She does not provide for the infant, does not have a stable home or
relationship. Barely visited the infant"

Avery's half-sister had been removed from Britney's custody under suspicion of abuse. Over time, Avery was given to the custody of the Hamilton County Jobs And Family Services, that was June of 2012. While Jonathan and Tammy had temporary custody, Britney was busy taking parenting classes and at one point accused Jonathan and Tammy of being unfit saying that Avery had been injured while in their care. It was reported that Jamie Hobbs did not attend the parenting classes.

In November of 2014, Tammy told the courts that Avery would often come back with bruises on her bottom and arms after she had visitations with her mother. It appears that Julie Pederson and Judge DeMott didn't care about the bruises because in March of 2015, Avery was given back to Britney. Less than a year and half later, Avery would be dead and who knows what abuse she suffered during that time at the hands of the woman she knew as her mother:

"This could've been stopped. This could've been prevented
if people would've listened"

Britney Roll Mayes was 24 years old when she was arrested and charged with the murder of her daughter, she was being held on a 2. million dollar bond, it was reported that she was seven months pregnant at the time of her arrest.

In court on August 17th, a Prosecutor in court told the Judge that Britney would be a threat to her unborn child. Dr Lakshmi Sammarco said that Avery had suffered blunt force injuries to her head and Judge Josh Berkowitch said that the allegations were beyond comprehension. The case was set to go before the grand jury for possible indictment on August 22, 2016. It had taken two weeks for Britney to be arrested after Avery's death and court documents said that Britney had caused the death of Avery:

"As a proximate result of the offender's committing a
felonious assault"

The Coroner ruled that Avery's death was a homicide:

"Avery suffered blunt force injuries to her head"

Tammy Risen expressed her gratitude to the Police for their work on the case:

"We would like to thank the police department for their efforts. They
gave Avery a voice. We have not had time to mourn Avery as we are
still fighting for her remains to bury her with dignity"

The last day that Avery was with her grandparents. Look at that smile, she lights up the room!

and ultimately JamieLee Hobbs ( Avery's father), she wrote. "It is with our deepest
gratitude for all of your support and again the police efforts. There are two funds
set for Avery. Avery Hobbs Memorial Fund at 5/3rd Bank and Avery Hobbs Memorial
Fund at Main Source Bank. Those funds will aid the family in our continued fight for
justice and her memorial. Thank you all."

A memorial service was being held on Monday, August 8, 2016 for Avery who was four years old at the time of her death. The service was held at 7:30 at the Trinity Lutheran Church in Colerain Township. The event was going to be open to the public.

In August of 2016 the Grand Jury indicted Britney Mayes on one count of aggravated murder, two counts of murder and one count of child endangering for what she did to Avery. Prosecutor Joe Deters said that if Britney is convicted on all charges, she faces life in prison without parole, that's what I, the author of this page, will be praying for:

"I am heartbroken that yet another baby's life has been taken by
her own parent. I will never understand how a parent can intentionally
cause this kind of harm to their child"
