Police responded to a home in Yuma, Arizona on May 31, 2011. I can't imagine what it must be like to be a
Police officer or someone in an ambulance who gets the call that a child is "unresponsive". So many times it turns out the child is dead and so many times it turns out to be abuse, this time would be no different.

Danielle Martinez was found not breathing and she had no pulse. Victor Noriega, who was the 29 year old boy- friend of 22 year old Sonia Sepulveda, was home baby-sitting when the call was made. Danielle was taken to Yuma Regional Medical Center and there, she was pronounced dead.

An autopsy would reveal that danielle had significant internal injuries and that older injuries suggested the child had been being abused. In fact, Danielle's spine was completely severed and it was called a "total separation of the lower spine". Victor was arrested and charged with  first degree murder as well as four counts of aggravated assault and one count of child abuse. Justice Of The Piece pro tem Yolanda Torok ordered Victor held with no bond. Prosecutor Karolyn Kaczorowski was asked if she had any comments for the court and she declined. Victor listened as the charges against him were read, he only spoke when he asked for a public defender and he showed no emotion at all.

Unfortunately, this was not the first time the child had been abused and at one point abuse or neglect of Danielle had been reported and in fact it was just a couple of weeks before this precious baby died, as it states below in a CPS report:

 A.  Circumstances of the fatality or near fatality that indicate it was the result of abuse or neglect:
      On May 31, 2011 Danielle Martinez Sepulveda was left in the care of Victor Noriega.  Mr. Noriega
      reported that he picked up Danielle and she became limp, defecated, and started to have seizure
      activities. Mr. Noriega called 911 and Yuma Police Department and Rural Metro Fire Department
      responded. Danielle was unresponsive and was transported to Yuma Regional Medical Center where
      she was pronounced dead.

 B.   Whether CPS has received any reports or past cases of child abuse, abandonment or neglect
        involving
the child and the current alleged abusive or neglectful parent, guardian or
        custodian* :


       On May 16, 2011, CPS received a report alleging neglect of Danielle Martinez Sepulveda. This
       report is
currently under investigation.

 1.    Actions taken by CPS in response to the fatality or near fatality of the child including:
        CPS is conducting a joint investigation with the Yuma Police Department.   
 2.    Actions taken regarding the child and/or other children in the home:
        There are no other children in the home.
 3.    Whether the agency is or intends to provide direct services or service referrals to the family:
        A determination of whether services are warranted will occur at the conclusion of the investigation,  
        which is still ongoing.

*Posted information provides whether there have been reports or any current or past cases of child abuse, abandonment or neglect involving the child who has died or suffered a
near fatality and the current alleged abusive or neglectful parent, guardian or custodian pursuant to A.R.S. § 8-807(F)(2)(a)(iv).

Information, if any, regarding other family or household members and the child or the alleged perpetrator is not posted on the Web site. UPDATE:

In August of 2012, Victor Noriega, who was 29 years old at the time, plead guilty to second degree murder and was scheduled to be sentenced to between ten and 22 years in prison, in September.

In September of 2012, Victor was sentenced to 18 1/2 years for killing Danielle.
