On August 29, 2011, a ten month old baby was brought into Mee Memorial Hospital with injuries that would cause him to die a few days later. Camilo Miramontes was living in a bedroom that was said to be cramped, with his mother, her boyfriend and another child. Diego was the boyfriend of Aracely, Camilo's mother and he worked long hours on a farm.

Doctors said that Camilo had a broken skull and two broken legs as well as older fractures that were in the process of healing. Diego Burgos, who was 20 years old at the time was accused of the abuse which took the life of this precious little boy and it was reported that the abuse had gone on for weeks, with the knowledge of the Camilo's mother, Aracely Mares. Camilo died of his injuries on September 5, 2011.

In court, text messages between Diego and Aracely were shown to the jury, in those messages Aracely said:

"That' was a kick with your f*****g boots"

Aracely was referencing bruises on her sons body. Of course Diego denied he had done anything to the baby and Aracely said to him:

"God forgive me if I'm blaming you and it's not you. But if it's not you, who else? You're
always with
him when that happens"

So here we have a mother who allows a man to KICK her ten month old son with steel toed boots and does nothing about it. Another "mother" who doesn't deserve to have the gift that God has given her.

A tape was played in court where Diego was telling Police that he had had kicked this baby with his boot. Defense Lawyer Miguel Hernandez said that the Police had manipulated Diego into making a confession:

"You'll hear the Investigators molding the ultimate statement"

Miguel compared this case and the evidence to the "Winchester House", saying it had doors that wouldn't lead them any where, calling it all circumstantial evidence. The District Attorney, Rolando Mazariegos said that he knew that Aracely Mares was a negligent enabler in this case:

"There are a lot of negative things we can say about Aracely Mares. You have to have a mother
like Aracely Mares to let in a physical abuser like Diego Burgos"

Rolando said that it was obvious that Diego hate this baby and that his heart was so cold  that he had bashed in the ten month olds head.

Aracely had said that the on August 29, 2011, she had seen a shadowy figure while she was making lunch for Diego to take to work and she believed that this figure was going to stab Diego, she said she had a premonition:

"She hallucinates. She's not very balanced and she's unstable"

Miguel told the courtroom that at one point, Aracely had taken a hammer to the stereo in the home. Rolando made it clear to the jurors that Aracely was not the one who was on trial at that time and that even without her testimony, there had been plenty of evidence against Diego. Rolando quoted the proverbial "It Takes A Village" when he said that so many people had failed this little Angel. Apparently, it wasn't just his mother and Diego who had refused to help him, other family members knew of the abuse and stood back doing nothing. Apparently, in the days before he was taken to the hospital, Camilo could no longer crawl due to both of his legs having been broken by the abuse he suffered, Rolando spoke of the pain he must have been in and said:

"This kid was being tortured"

Aracely testified that as the passed two state prisons on their way to the hospital, Diego said:

"I bet you I'm going to be going there"

To which she replied:

"I'm sorry for everything"

Apparently she's not sorry for everything or her child would still be alive because she would have put his safety first and removed him from the danger he faced living with Diego.

In January of 2013, Diego Burgos was sentenced to 37 years to life in prison. Judge Russell Scott gave Diego the maximum sentenced allowed and Diego showed no signs of emotion at all, as the sentenced was read. Aracely Mares was also facing charges of felony child endangerment. Miguel Hernandez said that he still believed that Diego was not guilty of the crime he was convicted of:

"I never once believed that he tortured that child. He was remiss in that he did not notice
what was happening with the child. The mother was abusing the child and Burgos ended
up being in the eye of the storm when everything hit"

Witnesses had testified that Diego didn't like Camilo at all and though that he was the cause of a miscarriage that Aracely had when she was pregnant with Diego's child.

On May 29, 2013, Aracely Mares, who was 21 years old at the time, plead guilty to child endangerment resulting in death. Aracely was sentenced to only ten years in prison for the torture, pain and suffering she allowed her baby to go through.


Camilo Esteban Miramontes, 10 months, of Greenfield, passed away Monday, September 5, 2011.

He was born October 28, 2010, in King City, to mother, Aracely Mares and father, Eduardo Miramontes.

Visitation will be held from 3:00 p.m. to 7:00 p.m., Friday, September 9, 2011, at Alta Vista Mortuary, 41 East Alisal St., Salinas, CA 93901.

Rosary will be held 7:00 p.m. Friday, September 9, 2011, at Alta Vista Mortuary, Salinas.

Funeral service will be held Saturday, September 10, 2011, at 1:00 p.m., at the Alta Vista Mortuary, Salinas.

Graveside service will held Saturday, September 10, 2011, at 3:00 p.m., at Holy Trinity Cemetery, 42603 Elm Ave., Greenfield, CA 93927.

Burial will follow at Holy Trinity Cemetery, Greenfield.
